{"id":703,"date":"2019-02-04T20:22:00","date_gmt":"2019-02-04T17:22:00","guid":{"rendered":"https:\/\/vs-pro.com\/en\/?p=703"},"modified":"2019-12-05T16:29:16","modified_gmt":"2019-12-05T13:29:16","slug":"consulting-engineer","status":"publish","type":"post","link":"https:\/\/vs-pro.com\/en\/2019\/02\/04\/consulting-engineer\/","title":{"rendered":"Consulting engineer"},"content":{"rendered":"<p><strong><u>Consulting engineer<\/u><\/strong> &#8211; a specialized engineering organization or specialist who provides organizational and consulting support for the design and construction of facilities.<\/p>\n<p>The consulting engineer acts as an expert who advises the customer on project implementation, deals with the selection of suppliers and contractors, objectively and independently manages construction at the site and fully accompanies the project at all stages. He is responsible for compliance with the law in terms of the powers delegated by the customer. If necessary, he is attracted to participate in resolving disputes, especially at the stages of pre-trial (out-of-court) dispute settlement: claim management, mediation, adjudication through the Dispute Adjudication Board (DAB), arbitration, etc.<\/p>\n<p>The State\u00a0Classification of Occupations SC 003: 2010 included a new profession \u201cconsulting engineer (construction)\u201d, the Directory of qualification characteristics of workers&#8217; professions (Issue 64 \u201cConstruction, installation\/mount and repair and building\/reconstruction services\u201d) defined the qualification characteristics of the profession \u201cconsulting engineer\u201d.<\/p>\n<p>The legislation defines the following terms and concepts related to the activities of the consulting engineer:<\/p>\n<ul>\n<li>engineering activity in the construction area (engineering) &#8211; the provision of engineering and technical services, which include conduction of pre-feasibility studies and researches; project expertise; development of construction financing programs, organization of conducting project documentation; organization of competitions and tenders; conclusion of contracting; coordination the activities of all construction participants, as well as implementation of technical supervision of the construction of architecture object and economical, financial or other consultation (Article 1 of the Law of Ukraine &#8220;On Architectural Activity&#8221;);<\/li>\n<li>consulting engineer &#8211; a business entity that provides road consulting services considering to the conditions specified in the contracts of the International Federation of Consulting Engineers FIDIC, or with the assistance of specialists who have a qualification certificate issued in accordance with the legislation for technical supervision of the construction of public roads (Requirements for the quality control of works on new construction, reconstruction and repair of public roads, approved by the Act by Cabinet of Ministers of Ukraine dated December, 28<sup>th<\/sup> of 2016 No. 1065;<\/li>\n<li>construction manager (engineering consultant in construction) &#8211; an individual with a qualification level, confirmed by a third party, or a legal entity (engineering company, which has specialists with qualification level, confirmed by a third party), which is within the authority delegated by the customer, manages the project implementation, provides the customer with advice on choosing the best ways to implement it, makes relevant decisions or issues on his behalf or performs other functions (Minimum requirements for labor protection on temporary or mobile construction sites, approved by the order of the Ministry of Social Policy dated June 23<sup> th<\/sup>, 2017 No. 1050, registered in the Ministry of Justice on September 8<sup> th<\/sup>, 2017 No. 1111\/30979).<\/li>\n<li>According to Amendment No. 2 to Ukraine State Standard B. D.1.1-1: 2013 \u201cRules for determining the cost of construction,\u201d taken by the order of the National Standardization Authority No. 102 dated April 16<sup>th<\/sup>, 201, construction customers of all forms of ownership were able to include in chapters 10, \u201cCustomer Service Maintenance\u201d (columns 6 and 7) of the consolidated estimate calculation of funds not only for the maintenance of the customer\u2019s service, including funds for technical supervision in the amount of up to 2.5%, column 7, but also funds in the amount of up to 3% for column 8 for attracting economic entities (individuals or legal entities), as well as provide customers with engineering services in construction.<\/li>\n<li>At the same time, the total cost of the services of the consulting engineer (enterprise) and the maintenance of the customer\u2019s service (including funds for technical supervision) should not exceed 5.50% of the cost of construction work (columns 8 chapters 1-9 of the consolidated estimate calculation).<\/li>\n<\/ul>\n<p>Legislation determines the way in which the customer performs its functions related to the organization of construction:<\/p>\n<ul>\n<li>The construction customer ensures the implementation of technical supervision during the entire construction period of the facility to monitor compliance with design solutions and the requirements of state building codes of standards and regulations, as well as monitoring the quality and scoped of work performed. Technical supervision is carried out by persons who have a qualification certificate issued in accordance with the legislation (Article 11 of the Law of Ukraine \u201cOn Architectural Activity\u201d, the Procedure for exercising technical supervision during the construction of an architecture object, approved by the Resolution of the Cabinet of Ministers of Ukraine dated July 11<sup>th<\/sup>, 2007 No. 903).<\/li>\n<li>The customer can ensure the implementation of technical supervision on his own, or delegate such authority to a third party &#8211; a specialized organization or specialist in accordance with the procedure established by law (clause 28 of the General Conditions for Concluding and Performing Contracts in Capital Construction, approved by the Cabinet of Ministers of Ukraine dated August 01<sup> th<\/sup>, 2005 No. 668).<\/li>\n<li>The customer has the right to control and supervise the construction and make relevant decisions on his own behalf to conclude an agreement on the provision of such services with a specialized organization or specialist. In this case, the construction contract defines the functions and powers of such a specialist (third part of Article 881 of the Civil Code of Ukraine).<\/li>\n<\/ul>\n<p>So, the construction customer, taking into account the cost, complexity and other features of the project, based on his own needs and capabilities, can:<\/p>\n<ul>\n<li>perform customer functions on his own and ensure the implementation of technical supervision by his own staff (funds for the maintenance of the customer\u2019s service, including funds for technical supervision, are provided in the amount of up to 2.5% of the total of chapters 1\u20139, column 7 of the consolidated estimate calculation);<\/li>\n<li>involve third-party organizations or specialists on a contractual basis in the implementation of technical supervision, leaving the remaining functions of the customer on himself (funds for maintenance of the customer\u2019s service in the amount of up to 1.0 % and for technical supervision in the amount of up to 1.5 % are included, together \u2013 2.5 %);<\/li>\n<li>involve a consulting engineer to perform part of the customer functions (funds up to 3% are additionally included, total 5.5%);<\/li>\n<li>involve a consulting engineer who will make all the necessary decisions on his behalf, professionally perform the functions of a customer and a wide range of duties defined by the contract (the amount of expenses is set at 5.5% of chapters 1\u20139 of the consolidated estimate calculation).<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>Consulting engineer &#8211; a specialized engineering organization or specialist who provides organizational and consulting support for the design and construction of facilities.
